Occasional volokh conspirator Eric Jaffe (and some other folks) have filed a Supreme Court cert petition about whether when the government uses your patent without your permission or royalties, is it a taking? That's a vast oversimplification; the case really turns on whether the patent infringement happens in the USA, where part of it does and part of it doesn't and the legislation construing when it is or isn't is a bit iffy.
