Trial by battle is an article by an economist looking at how combat was used to settle land disputes in england for 100 years after the norman conquest.

I liked the same author's earlier article on the economics of trial by ordeal.
Overall: the justice system has never worked especially well; it only needs to work better than nothing. The details have changed, but the arbitrary-ness continues.
