Levin, a friend of this blog, who filed a pro se cert. petition, has unanimously won at the Supreme Court.

The 9th Circuit is reversed, per Ginsburg. The Court is unanimous, but Scalia does not join 2 footnotes (presumably about legislative history).

The federal Gonzales Act abrogates the federal tort claims act intentional tort exception and permits Levin's suit alleging medical battery against a doctor acting within the scope of his employment. 

when was the last time a battery case was heard by the supreme court?
