What's the best way to speak anonymously in the modern age with all the tracking that goes on, government or otherwise?

In your estimation, based on experience or rumor, is Tor generally compromised/weak or is it hard enough to resist de-anonymizing attacks when used as intended?
Is there realistically any way to communicate anonymously with a modern smartphone?
Law:
What kind of legal limitations are in place on anonymous speech today? Do you see things trending toward further restriction or remaining stable?
